1. Introduction
All UsersThese Terms of Service (“Terms”) govern your use of E Building's platform, including the society management software, resident app, home services marketplace, and staffing services (collectively, the “Platform”).
By creating an account or using the Platform, you agree to these Terms. If you do not agree, do not use the Platform.
The Platform is operated by EBuilding Private Limited (“E Building”, “we”, “us”, “our”), a company registered in India.
2. Definitions
- Platform: E Building's website (ebuilding.in), society management software, resident app, and related services
- Society: A registered housing society, apartment owners' association, or residential community using the Platform
- Committee: The governing committee of a Society (president, secretary, treasurer, etc.)
- Resident: A flat owner, tenant, or family member registered to a Society on the Platform
- Vendor Partner: A service professional or independent business registered to deliver home services via the Platform (independent contractors, not employees of E Building)
- Staff Applicant: An individual registered to browse, apply, and obtain jobs directly with housing societies (independent platform users, not employees of E Building)
3. Using Our Platform
All Users- You must be at least 18 years old to create an account
- You are responsible for maintaining the confidentiality of your account credentials
- You must provide accurate, complete, and current information during registration
- You may not share your account with others or use another person's account without authorisation
- All account activity is your responsibility. Report suspected unauthorised access immediately to support@ebuilding.in
4. Society Committees
Committee AdminsWhen registering your society on E Building, you represent that you are an authorised committee member with the authority to bind your society to these Terms.
- You are responsible for managing resident access, permissions, and data within your society's account
- You must keep your society's data (flat master, resident list) accurate and up to date
- Maintenance fees collected via the Platform are held in your society's designated account — E Building acts as facilitator only
- You agree to use the Platform in compliance with applicable housing society laws and regulations in your state
5. Residents
Residents- Residents are added to the Platform by their society committee. E Building is not responsible for adding or verifying individual residents
- You may use the resident app to pay maintenance, approve visitors, book home services, and access society notices
- You are responsible for the accuracy of your contact details and flat information
- Gate entry approvals (visitor management) granted by you are your responsibility. Do not approve entry to unknown persons
6. Staffing Marketplace & Home Services Platform
For Societies, Staff & Partners6.1 Platform Role & Zero Employment Liability
E Building operates as a matchmaking and listing platform connecting housing societies with verified service professionals (Vendor Partners) and staff job seekers (Staff Applicants), similar to freelance directories. E Building does not act as an employer, recruitment agency, contractor, supervisor, or manager for any staff or service bookings. The actual contract of employment or service booking is directly between the housing society/resident and the staff member/service provider.
6.2 For Staffing (Jobs)
- Direct Employment: Any staff applicant hired by a housing society is an employee of that housing society (or their chosen third-party vendor), not E Building. The hiring housing society is solely responsible for employment terms, contracts, salaries, tax deductions, and statutory compliance (such as ESIC, PF, minimum wage, and working hours).
- Zero Commission: E Building does not charge or deduct any recruitment or agency commission from the salaries of matched staff. 100% of the salary is paid directly by the society to the staff.
- Platform Tools: E Building provides gate attendance logs, profile verification tools, and communication channels. Housing societies are solely responsible for evaluating credentials and managing staff. E Building has zero responsibility or liability for staff behavior, performance, or payroll.
6.3 For Home Services
- Independent Services: Residents book home services (e.g. AC service, plumbing, deep cleaning) directly with independent Vendor Partners registered on the Platform. E Building is not a party to any service booking and is not responsible for the quality, safety, or delivery of the service.
- Commission & Weekly Payouts: E Building collects booking payments from residents and processes weekly payouts to Vendor Partners for completed bookings, minus a transparent platform commission fee on the completed booking amount.
7. Payments & Billing
- Payments on the Platform are processed by Easebuzz, which are RBI-regulated and PCI-DSS compliant payment gateways
- E Building does not store your raw card numbers
- All subscription fees charged by E Building are subject to applicable GST. The Platform does not calculate, report, or generate GST invoices for society maintenance collections or resident dues.
- Society maintenance collection services include a small processing fee that is displayed before confirmation
- Disputed transactions must be raised with us within 30 days at support@ebuilding.in
- Refunds are governed by our Refund Policy
8. Prohibited Use
You must not use the Platform to:
- Violate any applicable law, rule, or regulation
- Transmit false, misleading, or fraudulent information
- Impersonate any person or organisation
- Attempt to gain unauthorised access to other accounts or our systems
- Scrape, crawl, or extract data from the Platform without written permission
- Introduce malware, viruses, or harmful code
- Use the Platform for purposes that compete with E Building without written consent
- Harass, abuse, or threaten other users or staff
- Misuse the SOS emergency feature with false emergency reports
9. Intellectual Property
All content on the Platform — including software, design, text, logos, and trademarks — is owned by or licensed to EBuilding Private Limited and protected by Indian copyright and intellectual property law.
You retain ownership of the data you upload to the Platform. You grant E Building a limited, non-exclusive licence to process that data for the purpose of providing the Services.
You may not copy, reproduce, distribute, or create derivative works from our Platform content without written permission.
10. Limitation of Liability
E Building provides the Platform on an “as is” and “as available” basis. To the maximum extent permitted by Indian law:
- We do not guarantee uninterrupted, error-free service at all times
- E Building is not liable for disputes between residents, committees, vendors, or third parties
- We are not liable for the quality of services delivered by Vendor Partners — those are independent contractors. Residents book services at their own risk.
- E Building is not responsible or liable for any staffing behavior, performance, attendance, employment disputes, or unpaid salaries. All staffing employment contracts and payments are exclusively between the housing society and the staff member.
- Our total liability to you for any claim is limited to the subscription fees paid by you in the 3 months preceding the claim
11. Termination
Either party may terminate their use of the Platform at any time:
- By you: Close your account from settings or contact support@ebuilding.in. Society committees must give 30 days' written notice to cancel a subscription.
- By us: We may suspend or terminate accounts that violate these Terms. We provide advance notice for non-violation terminations.
Upon termination, your right to use the Platform ends.
12. Dispute Resolution & Governing Law
These Terms are governed by the laws of India. Any dispute shall be subject to the exclusive jurisdiction of the courts of Bengaluru, Karnataka, India.
Before initiating formal legal proceedings, we encourage you to contact us at support@ebuilding.in to attempt resolution. We aim to address all disputes within 14 days of written notice.
